These Terms & Conditions (“Terms”) govern your use of EMSCON Guardian (the “Service”), provided by EMSCON Solutions, LLC (“EMSCON,” “we,” “us”). By creating an account or using the Service, you agree to these Terms.
EMSCON Guardian lets a “watched” person send safety check-ins and help/emergency signals from their own device, and lets their designated “guardians” receive those signals, request check-ins, exchange messages, and view location captured at the time of an event. Features and availability may change during beta.
You are responsible for the accuracy of the information you provide, for keeping your login secure, and for activity under your account. A family account administrator who adds members is responsible for those members and for any consent required to add them.
By providing a mobile number and using the Service, you consent to receive transactional SMS text messages from EMSCON Guardian relating to safety alerts, check-in requests, and account activity. Message frequency varies with activity; message and data rates may apply. Reply STOP to opt out of SMS at any time, or HELP for help. SMS consent is not a condition of purchase. Opting out stops text alerts to that number but does not delete your account.
Use the Service only for its intended personal-safety purpose and only with the involvement/consent of the people connected to your account. Do not misuse the Service, send false emergencies, or use it to harass, surveil, or track anyone without their knowledge and consent.
Paid plans (where offered) are billed through our payment processor. Trial terms, pricing, and cancellation are presented at sign-up. You can cancel per the options shown in the Service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE. We do not warrant that alerts or messages will be delivered, timely, or acted upon.
To the fullest extent permitted by law, EMSCON Solutions, LLC is not liable for any indirect, incidental, or consequential damages, or for any injury, loss, or harm arising from reliance on the Service, delayed or undelivered alerts, or inability to reach emergency help. Your remedy is to stop using the Service.
Our handling of your information is described in the Privacy Policy.
We may modify the Service or these Terms; continued use after changes constitutes acceptance. We may suspend or terminate accounts that violate these Terms.
